A law lecturer at the Kwame Nkrumah University of Science and Technology Ernest Kofi Abotsi has said President Mills has not erred in appointing a member of Council of State, J.H. Owusu-Acheamong as campaign manager for his flag-bearership bid. According to Lawyer Kofi Abotsi, there is nothing constitutionally wrong with the action of the President because the Council of State is not a representative body. “The people on the Council of State do not represent any region or people; their selection is supposed to demonstrate a certain national character of the composition of the council but they are not there to represent the background interest or the places from which they were chosen. It is only parliament that is a representative body in that capacity” he explained. His comments are in respect to a suit filed by Dennis Ofosu-Appiah, a civil rights lawyer and Head of the Centre for Constitutional Order, challenging the propriety of President Mills' decision to appoint Mr. Owusu-Acheampong as chairman of the Get Atta Mills Endorsed (GAME) Campaign Team. Mr. Ofosu-Appiah believes Mr. Owusu-Acheampong’s appointment as chairman of GAME could create problems for Ghana’s growing democracy should other members of the Council of State from different political parties also decide to publicly campaign for other political leaders. He wants the Supreme Court to bar him (Mr. Owusu-Acheampong) from holding himself as chairman of GAME. But Mr Kofi Abotsi, speaking on Citi FM explained that even though it is not expedient for members of the Council of State member to engage in active politics, there is nothing wrong with any member performing functions that are given to them under their political party affiliation. “The people on the Council of State are not prohibited beyond their functions as members of such council from doing other things considered partisan or political”.
