Four years after a Sunyani High Court ordered the payment of the remuneration and compensation due him, the former District Chief Executive (DCE), of the then Asunafo District Mohammed Kwaku Doku is yet to receive his entitlement. In view of this Mr. Doku has instructed his lawyers to file an application for fieri facias (Fifa) against the government. He told The Chronicle he was run out of patience not understanding why the Attorney General and Minister of Justicc and the Accountant General decided to flout an order by a High Court. According to Mr. Doku, he applied for a certificate of execution in accordance with Section 15 of the civil proceedings Act 555, which was duly served on the two to effect the payment, but it has allegedly been ignored. He said that the move came a year and half after the Sunyani High Court had given its ruling for the payment of the compensation which was also allegedly flouted. The ex-DCE told The Chronicle newspaper that government terminated his appointment by a letter dated February 9, 2001, in which it was stated that his salary and emolument would be paid after a special audit inspection of the District Assembly was completed. He further said that after the audit, he was cleared, which was indicated in a letter dated September 19, 2002, addressed to the Chief of Staff and copied the Brong-Ahafo Regional Minister, stressing "The audit report on Asunafo District Assembly has been completed and no adverse comments were made against Kwaku Doku during his short term in office." According to Mr. Doku, after waiting for some months without hearing from the Chief of Staff who was to process and pay him, he personally consulted the government through, Captain (Rtd) Nkrabea Effah-Dartey, who asked him to see the Chief of Staff. He alleged that he was thrown out of the office as soon as he introduced himself, and said that prompted him to seek redress at the Sunyani High Court in 2003. The Ex-DCE did not understand why the Attorney General's Office allegedly showed gross disrespect for the Sunyani High Court order and regretted the situation where the Attorney General or his representative never appeared before the court to ensure speedy adjudication of the case. According to Mr. Doku, "The Ministry of Justice, as it stands suffers some defects in exercising its powers in ensuring equity in the administration of justice between the citizenry and the executive arm of government." The Chrollicle says it believes Mr. Doku needs money and other logistics for his parliamentary campaign in this year's election at the Asunufo North Constituency, which was why he intensified his legal tussle with the government, just to have the money for the campaign. However, Mr. Doku insisted that he was only fighting for his rights and what is due him, and if the NPP, which claims to be the Apostles of Rule of Law, were now practicing selective justice in the country, then what would be the future of the nation. He queried whether since the year 200 I, the NPP Executives who have been removed from office have not been paid their entitlements, adding that even if one of them had been paid, it was a clear variation of the President's oath to do justice to all manner of persons.
