The Supreme Court, Tuesday, heard the legal arguments from lead counsels in the ongoing election petition filed by former President John Mahama on whether the First respondent, the EC mounts the witness box for cross-examination.






The lead counsel for the petitioner, Tsatsu Tsikata prayed to the seven-member panel of judges to dismiss the request to prevent Mrs Mensa from being cross-examined.



According to him, the EC Chair indicated during the application for some interrogatories that she was going to make herself available for cross-examination and for that reason, the court took the decision to dismiss the application of interrogatories filed by the petitioner.





However, citing Section 62 of the Evidence Act and Rule 3 (c) of C.I. 87, lead counsel for the First respondent, Justin Amenuvor stated that his client, Jean Mensa cannot be compelled to testify against her will.








Meanwhile, the Supreme Court judges have adjourned sitting to Thursday, February 11, to give its ruling on the said matter.
