The Criminal Procedure Code, 1960 (Act 30) of the Constitution provides a Ghanaian the ability to procure the release of an accused person from legal custody.
The rationale behind bail is based on the need to safeguard the basic rights of citizens since article 19 provides in subsection 2(c) that an accused person is presumed innocent until proven guilty,
In Ghana, some three types of bail applications are available for an accused person. These include police enquiry bail, bail pending trial and bail pending appeal.
