A Swiss company is seeking damage of up to 6.9 million dollars in special damages from Volta Aluminium Company, VALCO for breach of contract.
The company Glencore SA, dealers in raw products is accusing VALCO of refusing to raise letters of credit to pay for the delivery of 26,250 metric tons of alumina.
Glencore says VALCO placed the order and conveyed a sense of urgency with respect to the transaction, which compelled it to proceed to secure the goods and in August last year. It says after securing the goods, VALCO wrote back after series of correspondence to say it could not secure the letter of credit.
The Swiss company views this as a breach of contract and has therefore sued VALCO at the commercial court in Accra.
David Asiedu who is the lead counsel for Oxford & Beaumont Solicitors, representing Glencore says they are determined to pursue the case.
VALCO however says Glencore is not entitled to the claims because there was no concluded agreement between the parties to enable it to ship the goods, pointing out that the purported shipment was unsolicited and uncontracted.
