A stalwart of the opposition New Patriotic Party, Sam Okudzeto has sued the government for wrongful dissolution of the Board of the Bank of Ghana.
A member of the dissolved Board, Mr. Okudzeto said the action of the president amounted to a flagrant violation of the laws of the land.
He therefore filed a writ at the Fast Track, seeking a declaration by the court that the action of the president was illegal, null and void.
President J.E.A. Mills soon after taking office dissolved the Boards of all state Institutions, agencies and other Parastatals.
He subsequently reconstituted the Board appointing new members to replace Mr. Okudzeto and others.
But the legal luminary, who was affected by the action, believes the president had no power to dissolve the Board of the Bank of Ghana and is seeking an order to restrain the president from swearing in the new members to the Board.
The reliefs he is seeking are:
- A declaration that the purported withdrawal of the appointment of the Plaintiff and all other external Directors of the Board of the Bank of Ghana when their fixed term has not expired under the governing law is illegal, void and of no effect.
- A declaration that the purported appointment of new members to the Board of the Bank of Ghana when the fixed term of the Plaintiff and other Board members subsists is a flagrant contravention of the laws of the Republic of Ghana, illegal. null and void.
- An order setting aside the purported appointment of the new members to the Board of the Bank of Ghana.
- An order restraining the 1st Defendant and in particular H.E. the President of the Republic of Ghana from swearing in the purported new appointees to the governing Board of the Bank of Ghana.
- An order compelling the 2nd Defendant to convene forthwith regular meetings of the current Board of the Bank of Ghana of which the Plaintiff is a member to deliberate on matters affecting the monetary policies of the country.
- An order restraining H.E. the President from interfering with the performance of the functions of the current Board of the Bank of Ghana during the subsistence of their term.
- Any further order(s) and consequential order(s) as this Honourable Court may deem fit.
