The Minority Chief Whip, Mohammed Mubarak Muntaka, has described the Clerk of Parliament's statement that he will not recognise Assin North MP-elect as an illegality.
Cyrill Nsiah told the House that he had received the injunction order against James Gyakye Quayson, after Effutu MP-elect, Alexander Afenyo Markin enquired during the inauguration of the 8th Parliament.
According to the legislator, considering the Court's order Mr Gyakye Quayson cannot partake in the election of a Speaker.
But in a sharp remark, Mr Muntaka stated that the law does not give the Clerk the mandate to make such pronouncement, thus, he is engaging in illegality in taking that decision.
“Remember you do not have the authority to do what you did because what you did is indirectly serving the Member in the chamber.
"If the Member is aware that there is a court injunction against him and he decides to come here to be sworn in, it is a matter for him and the Court.
“It is not on you because you as a clerk, your duty is to be to tailor us through the election but you don’t have the authority to tell us or serve a member.
"So please be mindful because you as the Chair, you are involving an act in an illegality,” he said.
The decision to exclude him from voting the next Speaker generated a lot of verbal exchanges between members of the Majority and Minority on the Floor.
Eventually, Mr Nsiah withdrew his decision to prevent the embattled MP from voting.
Distancing himself from any ramification of his participation in the electoral process, he said the decision to vote or not lies with James Gyakye Quayson.
