Today, JoyNews' The Law delved into the issue of sexual harassment.
Section 175 of the Ghana Labour Act 2003 (651) interprets sexual harassment as “any unwelcome, offensive or importunate sexual advances or request made by an employer or superior officer or a co-worker, whether the worker is a man or woman.”
Harassment is a serious offence under the Criminal Offences Act No. 29 and the 1960 Labour Act of Ghana. Sexual assaults of any form including rape, defilement, unnatural carnal knowledge and harassment are regarded as serious offences (i.e. first-degree felony), that are liable on conviction to a term of imprisonment not less than five years and not more than 25 years (Criminal Offences Act 1960, Act 29).
