The Court of Appeal has unanimously dismissed an appeal filed by Dr Cassiel Ato Forson, the first accused in the Fake Ambulance Trial, who claimed that the charges against him were defective.
Dr Forson argued that the charges of wilfully causing financial loss to the State and intentionally misapplying public property lacked sufficient particulars.
However, on June 8, 2024, the Court, comprising Bright Mensah JA (Presiding), Bartels-Kodwo J.A., and Amaleboba J.A., ruled that the appeal was "without merit."
Previously, Dr Forson sought to strike out the charges at the High Court, which also dismissed his application.
Undeterred, he appealed, alleging that the High Court judge erred in finding that the particulars of the charges contained sufficient information.
The Attorney-General, represented by Principal State Attorney Richard Gyambiby, defended the charges, saying they met legal requirements.
The Court of Appeal agreed, noting that the charges should be considered entirely and not by isolating specific phrases.
The court emphasized that the charges against Dr Forson, detailing his alleged authorisation of irrevocable letters of credit valued at €3,950,000 and misapplication of €2,370,000 for non-existent ambulances, were sufficiently detailed as required by law.
Dr Forson was represented by his lawyer, Dr Abdul Bassit Aziz Bamba.
