The former General Secretary of the New Patriotic Party (NPP), Kwabena Agyei Agyapong, has challenged the authority of the Office of the Special Prosecutor (OSP) in declaring former Finance Minister Ken Ofori-Atta a fugitive.
Mr Agyapong, speaking in an interview with Citi FM on Tuesday, 3rd June 2025, argued that such a declaration falls strictly within the remit of the courts and not investigative agencies.
"You are not a judge yourself to be able to declare someone a fugitive just because you cannot have access to the person, " he said.
His comments come in the wake of a public announcement by the Special Prosecutor Kissi Agyebeng, stating that Mr Ofori-Atta is considered a fugitive, following his failure to return to the country and respond to ongoing investigations.
Mr Agyapong emphasised the importance of due process in pursuing accountability and urged state institutions to operate within the boundaries of the law.
"What happens to the basic law which says that you are innocent until you are proven guilty?"
The Office of the Special Prosecutor has defended its stance, indicating that Mr Ofori-Atta had failed to present sufficient evidence to support claims that he's medically unwell and had not cooperated with efforts to advance the case against him.
The OSP has since reinstated him on its list of wanted individuals.
