High Court judge, Justice Paul U. Dery, has asked the Chief Justice to remove from all his cases, a Court of Appeal judge.
Justice Dery, who is fighting attempts to remove him, wants Chief Justice Georgina Theodore Wood to remove Justice Gertrude Torkonoo from cases he brought to the High Court to contest his removal.
In a two-page petition to the Chief Justice, Mr. Dery accused his fellow judge of “…arbitrariness, capriciousness or bias as a result of either resentment, prejudice or personal dislike.”
Justice Torkonoo was empanelled by the Chief Justice to hear all cases brought by judges against whom petitions had been filed for their removal.
Tigereyepi brought petitions for the removal of 12 High Court judges and 22 lower court judges.
They were accused of trading justice for pecuniary and other material benefits.
The evidence against them was documented in audio-visual recordings collected by journalist Anas Aremeyaw Anas and his Tigereyepi company.
Some of the judges did not contest the results of Anas’ investigations but others are challenging the legality of the procedures adopted in collecting the evidence which formed the basis for the petitions for their removal.
Justice Dery is one of them. His problems with Justice Torkonoo started when his application for contempt was dismissed by the Court of Appeal judge.
He argued the judge erred in hearing and dismissing his application without notice to him or his lawyers.
He brought a case against the judge at the Supreme Court but that case was thrown out.
Apparently determined not to let the matter rest, Justice Dery petitioned the Chief Justice to remove justice Torkonoo from his cases.
