An Accra High Court has adjourned the case involving Gregory Afoko following a petition from the late Adams Mahama family.
The case has been adjourned to May 3, 2016, by Justice Lawrence Lazaglah Mensah to enable the court to await directive from the Chief Justice on a petition filed by the Adams Mahama family to the court.
According to a petition filed by the family of the late NPP Chairman Tuesday, April 19, the family is against the judge’s order to continue to keep the accused in police custody instead of prison custody.
They are also against the judge's instruction that the prosecution should bring their witnesses on time.
Background
Gregory Afoko is standing trial for the murder of the late Upper East NPP Chairman, Adams Mahama who died after a gruesome acid attack.
Gregory and Asabke Alangdi were charged with two counts of conspiracy to commit crime and murder.
A third accomplice, Musa Issa was granted bail after the Attorney General advised that there was not enough evidence to charge him.
Trial
The trial for Gregory and Asabke Alangdi was scheduled to start on March 23, 2016, but was postponed to Tuesday, April 5 due to the absence of the trial judge, Justice Lawrence Lazaglah Mensah, an appeals Court judge with additional responsibility as a High Court Judge.
At the court on April 5, the lawyer for the accused, Israel Ackah said the facts as presented by the prosecution were not conclusive and did not establish the guilt of the accused.
A seven-member Jury was selected to try the accused after the submission by his lawyer. Mr Afoko's rejection of three of the Jurors prompted their replacement.
The lawyer for the accused asked the jury to carefully assess the facts and come to a just verdict by acquitting the accused.
