The Supreme Court has unanimously rejected preliminary objections raised by NPP Chairman Jake Obetsebi-Lamptey questioning its jurisdiction to hear a case brought against him by two private citizens.All nine members of the court, led by Justice William Anaam Atuguba, said the Supreme Court’s jurisdiction could not be ousted in the matter in which Dr Omane Boama and Mr Smuel Okudzeto Ablakwa are challenging Mr Obetsebi-Lamptey’s right to purchase a government bungalow he occupied as a minister of state.Dr Boama and Mr Ablakwa brought the action against the NPP Chairman in 2008 seeking a declaration from the Supreme Court that he was not entitled to purchase the bungalow he occupied then.The plaintiffs argued the principle was wrong and the process was murky and ought to be stopped but Mr Obetsebi-Lamptey raised a preliminary objection to the filing of the application at the Supreme Court.He argued the plaintiffs ought to apply to the Commission for Human Rights and Administrative Justice (CHRAJ) if they thought he was abusing his office by applying to purchase the bungalow.But the court rejected his argument, saying it has the jurisdiction to hear the matter. The merits of the case will now be considered at a later date.
