Lawyer and former Member of Parliament for Gomoa West, Alexander Kojo Abban, has voiced his disapproval of Speaker Alban Bagbin's recent remarks accusing the Judiciary and Executive of colluding to undermine Parliament’s authority.
Mr. Abban described the Speaker’s statements as “very unfortunate,” expressing concerns that such comments could strain the relationship among Ghana’s branches of government.
Speaker Bagbin raised alarm over what he termed as interference by the Judiciary and Executive, suggesting that these arms of government were overstepping their boundaries and thus threatening to destabilise Ghana’s democratic foundation.
He warned that, if unchecked, these actions could undermine the institution of Parliament and disrupt the constitutional balance intended to support Ghana’s democratic system.
But in an interview with JoyFM’s Top Story on November 6, Mr Kojo Abban responded to the Speaker’s claims, cautioning against assumptions of judicial overreach.
“That statement is very unfortunate to come from him,” he stated.
He pointed out that the Judiciary traditionally acts only when called upon, stressing that it cannot independently “encroach on the terms of any other person unless and until somebody comes before them.”
He highlighted this principle with an example, noting that during the ruling on the Fomena case under former Speaker Prof. Mike Oquaye, the Judiciary refrained from intervening because no one brought the matter before them.
