A former Supreme Court Judge, Justice Yaw Kpegah, has filed a writ at a High Court in Accra to prevent Nana Akufo-Addo presidential candidate of the NPP from holding himself out as leader of the NPP. According to him, Nana Akufo-Addo did not attain the over 50 per cent votes needed for him to be crowned as presidential candidate of the party. The NPP presidential candidate was popularly acclaimed by delegates of the party and 16 other candidates contesting the party’s presidential slot, after he failed to garner the 50 per cent plus one vote needed. His closest rival Alan Kyeremanteng conceded defeat, effectively aborting a crunch run-off between the two candidates. However, Justice Kpegah says that was flagrant violation of the party’s own constitution and the national constitution. The Electoral Commission and the National Council of the NPP have also been summoned. Justice Kpegah told Joy News his action is motivated by the failure of Nana Akufo-Addo to concede defeat to Prof John Evans Atta Mills in the just ended election run-off. “Nana Akufo-Addo has no locus in relation to the 2008 presidential election” he insisted. But the Communications director of the NPP Dr. Arthur Kennedy says Justice Kpegah’s argument is moot. Justice Kpegah tended in his resignation as a Supreme Court Judge two days before the December 7 general election after he filed a suit against the government for alleged breaches of the 1992 constitution.
