Legal counsel for former Finance Minister Ken Ofori-Atta, Mr Frank Davies, has issued a sharp rebuttal to assertions by the Office of the Special Prosecutor (OSP) that it has not received a certified medical report justifying Mr Ofori-Atta’s absence from Ghana.
The OSP had earlier dismissed a purported medical report suggesting that the former minister is medically unfit to travel and assist in ongoing investigations. The office stated categorically that it has not received any such documentation from Mr Ofori-Atta or his legal team.
The disputed document, dated 14 May 2025 and reportedly signed by Dr Ahmed Abdalrhim, an internal medicine specialist at the Section of International Medicine, Mayo Clinic in Rochester, Minnesota (USA), surfaced online on Tuesday, June 3.
Responding to the OSP’s claims, Mr Davies insisted that the medical report had already been submitted through formal legal channels.
“This is a very unclever attempt to ignore and deny evidence that has already been provided,” Mr Davies stated. “The medical report was included in the bundle of processes filed in court on 27 May and served on the OSP—unless, of course, he [the Special Prosecutor] does not read what is served on him.”
Speaking on Top Story on Joy FM, Mr Davies also questioned the basis for the OSP’s public commentary, which referenced Mr Ofori-Atta’s cancer diagnosis while allegedly lacking access to the relevant medical records.
“He didn’t see a biopsy test, but he can say Ken is suffering from cancer. Did he pick that information from the sky?” he asked.
Mr Davies concluded by urging the OSP to act with fairness and impartiality, particularly given the authority and responsibility that come with the office.
“When you are a public officer entrusted with discretion to perform your duties, you must exercise that power reasonably, fairly, and objectively,” he cautioned.
