Member of Parliament for Old Tafo, Vincent Ekow Assafuah, has expressed disappointment in the Supreme Court’s decision to dismiss his application seeking to halt the removal and suspension of Chief Justice Gertrude Torkornoo.
In a narrow 3-2 majority decision, the court dismissed the request, with Acting Chief Justice Paul Baffoe-Bonnie sitting on the panel alongside Justices Yonny Kulendi and Amadu Tanko. Justices Henrietta Mensah Bonsu and Ernest Gaewu dissented.
Speaking after the ruling in an interview on Asempa FM’s Ekosii Sen show, Mr. Assafuah questioned the impartiality of the process, particularly the decision of the Acting Chief Justice to empanel himself.
The MP stressed the importance of justice being seen to be done and hinted at a possible review of the ruling.
The full reasons behind the court’s decision will be released on May 21, 2025.
“I believe that when we say justice must be seen to be done, it is crucial for public confidence. If I were the Acting Chief Justice, I would recuse myself from this matter to allow the Ghanaian people to see and believe that true justice is being served—especially knowing that there are many capable judges available to handle the case.
“While I won’t argue that it is unconstitutional, I think that the Acting Chief Justice should not be the one to preside over such matters. In my opinion, the court erred in this situation,” he said.
