The Supreme Court will today, Tuesday, December 16, consider an application challenging the decision of the Tamale High Court that set aside the results of the Kpandai parliamentary election.
The application was filed by Kpandai Member of Parliament, Mathew Nyindam, who is contesting the High Court’s ruling that annulled the December 7, 2024, parliamentary polls in the constituency. He argues that the court wrongly assumed jurisdiction in the matter.
Mr Nyindam is asking the apex court to review and quash the High Court judgment, which followed an election petition filed by the National Democratic Congress (NDC) candidate, Daniel Nsala Wakpal.
He maintains that the petition was invalid and that all proceedings arising from it should be set aside.
In his application, the former MP contends that the High Court acted outside its legal mandate and committed errors that warrant the intervention of the Supreme Court through judicial review.
After the High Court’s decision, the New Patriotic Party (NPP) filed an application for a stay of execution, seeking to halt any steps by the Electoral Commission and the NDC to enforce the annulment while the matter is determined by the Supreme Court.
