This morning on Newsfile, host Samson Lardy Anyenini and his panelists discussed the Attorney General, Dr Dominic Ayine's justification to drop the criminal case against defunct uniBank founder, Dr Kwabena Duffuor and seven others.
According to the AG, recovering a substantial portion of the misappropriated funds was a more prudent course of action than risking a total loss.
The AG at the Government Accountability Forum on Monday, 28th July, explained that retrieving 60 per cent of the funds was a practical solution given the high risk of an acquittal if the case had proceeded to trial.
"On the contrary, the records show that the charges (against Dr Duffuor and seven others) were contestable and there was a high likelihood that the defence could have raised sufficient doubt to procure an acquittal, and if that happened, I see from the Beige Capital case, I would not have been able to recover GHC1.00."
Meanwhile, the Minority has announced its intention to take legal action against the Attorney General, Dr. Dominic Ayine, over his decision to discontinue the criminal prosecution of defunct uniBank founder, Dr. Kwabena Duffuor.
Also this week, the Human Rights Division of the High Court in Accra has dismissed a judicial review application filed by suspended Chief Justice Getrude Torkonoo.
The court, presided over by Justice Kwame Amoako, was of the view that the application constitutes an abuse of court process and that it lacks jurisdiction to consider it.
This latest judicial review follows an earlier constitutional interpretation case that the Chief Justice filed at the Supreme Court.
Additionally, her request for an injunction to stop the impeachment process was previously denied.
And also, the Office of the Special Prosecutor (OSP) earlier charged former Board Chairman of the Ghana Airports Company Limited (GACL), Paul Adom‑Otchere, along with two other individuals, in connection with an investigation into a revenue assurance contract awarded without competitive procurement.
The OSP in a statement posted on its social media pages today, July 31, said Mr Adom‑Otchere has not yet met the bail conditions requiring him to present two landed properties in Ghana registered in his name.
He has, however, informed authorities that he does not own any such property locally and remains in custody until the conditions are satisfied.
However, he was released from the custody of the Office of the Special Prosecutor in the company of former Attorney General, Godfred Dame, and his lawyers.
His legal counsel, Nicholas Lenin Anane Agyei, told JoyNews that the broadcaster and former Board Chairman of the Ghana Airport Company Limited has not been formally charged with any offence following his release from the Office of the Special Prosecutor (OSP).
