The Deputy Leader of the Majority group in Parliament, Alexander Kwamina Afenyo-Markin says legally the caucus of the National Democratic Congress (NDC) in Parliament has 136 seats and not 137 seats as being claimed.
Speaking in an interview, Mr Afenyo-Markin explained that due to the injunction placed on the NDC MP for Assin North, James Gyakye Quayson earlier this year, he cannot hold himself as a legislator.
“As we speak today, the NDC side is supposed to be 136 because there is an interlocutory order, sanctioning the Assin North MP. This order was communicated to him by the clerk of the House and I raise it on floor of the House.
“The Minority Group Leader, Haruna Iddrisu spoke to the issue and said that he as a leader has explained the consequences of the MP’s action to him, and he has elected to disobey Court process. So in real terms, the NDC has 136 as we speak today,” he emphasised.
Commenting on the way forward, the Effutu legislator said, “We have left that matter for the lawyers of the applicant in that suit to deal with it. I think that is clear, there is nothing like any ambiguity.”
The lawyers of both the petitioner, Michael Ankomah and the defendant, Mr Quayson have so far refused to comment on the matter as they run the risk of revealing their strategies.
A Cape Coast High Court, on Wednesday, January 6, granted an injunction against the MP-elect for Mr Gyakye Quayson.
The court ruled that the MP cannot hold himself out as the MP-elect for the constituency.
The petition which was filed by one Michael Ankomah indicated that the MP-elect still held on to his Canadian citizenship when he was filing to contest in the December polls.
He, therefore, beseeched the court to declare his position as MP-elect null and void.
