Philip Addison has resurrected claims of vote padding and vote deduction in the 2012 general elections held last December after he was given the green light to proceed by judges hearing the Presidential Election Petition.
Respondents in the Petition, raised vehement objections to attempts by the Counsel for the Petitioners Philip Addison to fall back on allegations of vote padding.
Addison in cross examining Dr Kwadwo Afari Gyan, witness for the second Respondent cited the allegations of vote padding in the Ledzorkuku Constituency.
He wanted the witness who was the Returning Officer in the 2012 elections to explain the discrepancies in the results on pink sheets and those declared by the EC in the Ledzorkuku Constituency.
But he was stopped in his tracks by the Respondents who alleged that the Petitioners have abandoned these specific allegations and must not go back there again.
In court Tuesday, Tsatsu Tsikata read out portions of the transcript in which Bawumia said the Petitioners have not come to court to prove allegations of official collusion, vote padding and deduction but rather allegations of over-voting among others.
Quarshie-Idun also made reference to 25th April transcripts in which Dr Bawumia under cross examination said they were not relying on the allegations of vote deduction and padding but rather relying on a third claim of constitutional and statutory infractions.
In his defense, Addison said the claims were part of their pleadings and affidavit which were clearly spelt out in their second amended petition.
Portions of this answer read that the Petitioners had received several complaints about “inexplicable differences” and “discrepancies” in constituencies like Ledzekuku and Dome-Kwabenya. They have claimed that votes garnered by the governing NDC were “illegally padded” while the opposition NPP was “unlawfully reduced”.
He said Dr.Bawumia did not have the full complement of the pink sheets during his cross examination that was why he said they are abandoning the case.
The counsel for the Petitioners said their question on Ledzorkuku is to test the credibility of the E.C’s witness Dr. Afari Gyan. He remarked that it will show that declaration of votes from this constituency was not in accord with the facts on the E.C’s pink sheet.
Tsatsu Tsikata rebutted that even if the Petitioners had pleaded to this they abandoned it.
The court after considering the arguments returned with a 7-2 ruling quashing the objection by the Respondents.
