The legal counsel of 2020 NDC Presidential candidate, John Mahama is concerned about the Electoral Commission's (EC) adamant posture against producing the original documents of the 2020 presidential election results in court.
The Counsel’s concern comes after the lawyers for the EC sternly kicked against the request by Mr Mahama in the Apex Court to be allowed to inspect documents in the custody of the EC.
These documents, according to the petitioner, were relied upon by the EC to announce the results of the presidential elections across polling stations, constituency, regional, and national collation centres.
However, the lead counsel for the EC, Justin Amenuvor opposed the request, arguing that the documents are already in the custody of Mr Mahama through his agents who monitored the elections across the country.
Although the request by Mr Mahama was dismissed by the seven-member panel of judges, the argument of the EC legal representative has left lingering questions on the minds of the petitioner's lawyers.
While addressing the press after proceedings Wednesday, Feb 3, the spokesperson for Mr Mahama’s legal team, Marietta Brew Appiah-Oppong insinuated that the EC had something to hide for which reason they are opposed to making those documents available in court.
She insisted that if the Commission and its Chairperson, Jean Mensa conducted the election fairly as they claim, they would not hesitate to produce the original documents.
“In any case, the EC is supposed to be an impartial institution in this whole election process. So what do they have to hide? What prejudice will be occasioned to them if they produce the documents for us to see? None, whatsoever.
"If you conducted your activities as EC, as EC Chair, fairly, transparently, impartially, why would you not produce the documents for us to see?” She questioned.
