The Supreme Court today gave its verdict on the joint application by lawyers for the Electoral Commission (EC) and President Akufo-Addo not to present witnesses in the ongoing election petition hearing.
Citing Order 38, rule 3 (e) sub-rule 1 and 5 of CI 47 as amended by CI 87, lead counsel for the EC, Justin Amenuvor argues that his client cannot be compelled to testify.
On his part, the lead counsel for Akufo-Addo, Akoto Ampaw said the burden of proof lies with the petitioner and not the respondents.
All these arguments were objected to by lead counsel for the petitioner, Tsatsu Tsikata, who says it is the constitutional duty of the EC to clarify some issues.
