The Minority has hinted at possible constitutional enforcement action if what it describes as non-compliance with DACF obligations persists.
Mr Annoh-Dompreh noted that Article 2(1) of the Constitution permits any citizen or institution to seek enforcement before the Supreme Court where constitutional breaches are alleged.
“Constitutions do not enforce themselves,” he remarked. “When administrative practice diverges from constitutional command, enforcement mechanisms must be considered.”
However, he clarified that litigation is not the preferred route. Instead, he urged Parliament to codify Supreme Court compliance requirements directly into fiscal statutes to prevent recurring violations.
He also called for strengthened parliamentary oversight, including mandatory quarterly reporting by the Minister for Finance detailing total revenue collected, DACF computation, actual transfers and outstanding balances.
“Oversight must have consequences,” he warned, suggesting that persistent non-compliance could trigger parliamentary sanctions.
