The South Dayi MP says the Supreme Court has done an injustice to his Assin North counterpart, James Gyakye Quayson with its ruling injuncting him from performing parliamentary duties.
Rockson Dafeamekpor has thus advised his lawyers to apply for a review, an application he says should be done even before the substantive case pending before the court is heard.
Speaking on JoyNews’ AM Show on Thursday with Benjamin Akakpo, he stated that the Supreme Court is the highest form of discharging the law in the country, so its decisions can be reviewed when there are disagreements.
In a majority 5-2 decision on Wednesday, April 13, the Supreme Court ruled that Mr Gyakye Quayson can no longer perform Parliamentary duties.
This is until the determination of the substantive case filed against him at the Supreme Court.
However, Rockson Dafeamekpor said the ruling is harsh on the Assin North MP. As a result, he envisages the court can depart from the same.
"The court has done an injustice to Quayson and I advise that the lawyers should be able to apply for a review even before the substantive matter is determined on its merits. The Supreme Court is the highest form of discharging the law.
"So when they do things, and you disagree, you go back to them. There are a plethora of decisions where the court has departed from things that they have said before."
Meanwhile, CDD Fellow, Professor Stephen Kwaku Asare is rather confident the Court will call for by-elections to be held for the constituency.
As result, he has advised the Assin North MP to officially resign and run again for the bye-election.
He further urged the legislator to try and win the election to “show us how wrong we do things and how inconsistent, and how incoherent our jurisprudence has become.”
