The Member of Parliament for South Dayi, Rockson-Nelson Dafeamekpor, has stated that Parliament must first take action on the recent Supreme Court ruling before it becomes binding.
According to Dafeamekpor, any Supreme Court decision requires a formal endorsement from all 275 Members of Parliament to be effective.
Speaking in an interview with JoyNews, he clarified that Parliament, as a collective body, must deliberate and decide how to implement the ruling.
“In any case, a decision has to be taken by Parliament to give effect to this ruling and it has to be taken by the 275 Members of Parliament,” he pointed out.
His comments come after the Supreme Court, in a 5-2 decision, declared that Speaker Alban Bagbin’s action of declaring four seats vacant was unconstitutional.
Chief Justice Gertrude Torkornoo announced on Tuesday, November 12, 2024, that the Speaker's declaration could not be held.
In response to the ruling, the lawmaker expressed disappointment in the court’s decision, suggesting that the ruling was flawed.
“I am sad by the decision of the court. I think the court fell into an error of compromise,” he said.
He added, “Is the court saying Cynthia Morrison is not running as an independent candidate in Agona West, even though she is presently the NPP-sponsored member of Parliament for Agona West?
"Is the evidence before the court that the independent member of Fomena, now the sponsored candidate of the NPP under the symbols and colours? …So unless I see the reason, I don’t know what the court is saying.”
